Abstract
In modern Italian society the number of foundations is increasing more and more. This phenomenon is due to several reasons: the expansion of nonprofit organizations to supply the crisis of welfare state; the privatisation of many activities which were carried by the state and are now carried by foundations created by the state itself. There are now different types of foundations and some of them are ruled not only by the civil code (as the traditional model of foundation) but by a specific law as well. Because of this evolution the characters of modern foundation are often different from the model of foundation in the civil code. Moreover, the recently created foundations are different from each other. Therefore, the part of the civil code concerning foundations needs to be reviewed; different regulations suitable to the different types of foundations are also needed.
