Abstract

The Law and disputes concerning foreigners : the stakes, conflicts and decision-making processes The process by which foreigners are temporarily allowed to stay in France implies a certain number of stakeholders with different powers and functions. Decisions to grant or refuse the right to stay in France in keeping with the law, follow an administrative and legal process which is developing in terms of legal disputes concerning the rights of foreigners. This article focuses on the relations which link 3 different types of stakeholders involved in these legal disputes : officials working at the prefecture, magistrates and lawyers. It offers an analysis of the organisational and structural factors involved in the decision-making processes and describes their conflictual relations with the subjective and individual considerations of the stakeholders.
