Abstract

With the aging of the lawyer population, and attendant health issues, as well as the substantial addiction and mental health problems afflicting the profession, the threat of lawyers representing clients when they are no longer capable of doing so is on the rise. One of the most powerful, but least studied, regulatory responses is to transfer such lawyers to disability inactive status while retaining the possibility that they will be reinstated if the condition necessitating transfer is ameliorated. In this article, I provide the first comprehensive description and analysis of this important regulatory device.
