Abstract

Under the doctrine of sovereign immunity, a state is immune from suit. However, because of a Texas law that allowed citizens to file suit because of the inaction of the Texas Natural Resource Conservation Commission (TNRCC), this doctrine did not bar a landowner's action against TNRCC.
