Abstract

The safeguarding of individual rights is one of the vital needs of a civilized society and must be given more importance in a democratic country like India, where protection of human rights and assuring self-respect to the individual is the responsibility of a welfare state. One major factor that thwarts the universal realization of human rights is domestic violence. Thus, Indian legislature made laws against domestic violence especially to bring an end to the atrocities against women. However, now these laws are being misused to such an extent that the individuals suffering from its misuse are far outnumbered in comparison to the women suffering from domestic violence. Thus, it is essential to make necessary amendments in the current laws on domestic violence in order to control its misuse so that justice can be guaranteed only to those women who are genuinely abused.
