Abstract

Much has changed since the bedrock of the criminal law was laid in the last century. In some areas the problem is one of antiquated language rather than outmoded ideas. In others, such as sexual offences, perceptions of the roles and functions of women, men and sex have undergone so great a shift that a reexamination of the purpose and content of the law is long overdue. If the Fifteenth Report' of the Criminal Law Revision Committee2 is anything to go by, it does not look as though there is going to be any radical change. The Report recommends few changes to the existing law. This contrasts with Canada where rape was last year replaced by the crimes of sexual assault and aggravated sexual assault.3 The initiative for this bold move came from the Law Reform Commission of Canada's Report on Sexual Offences in 1978.
