Abstract

Estudio de las garantías de la segunda instancia en el proceso penal, tal y como han sido interpretadas por la jurisprudencia del TEDH y del TC, poniendo de manifiesto su incompatibilidad con el actual régimen legal, lo que ha convertido a nuestro actual sistema de recursos en una regulación meramente formal, carente de contenido, razón por la cual urge una reforma legislativa.A study of appeal guarantees in the second instance of criminal proceedings, as interpreted by the case law of both the ECHR and the SC, demonstrate their incompatibility with the current legal regime, with the result that the regulation of the Spanish criminal appeal system is a mere formality, devoid of content, which is reason enough for urgent legislative reform.
