Abstract

Important reasons why laymen do not help in emergencies are fear of criminal procedure or civil law consequences due to wrong measures. Any citizen who does not help in emergencies according to his possibilities exposes himself to the danger of criminal prosecution because of failure to render assistance. Which help is reasonable depends on the individual conditions of the helper, particularly his experience and his level of training. If the victim is not able to give consent, the principle of presumed consent or agency without authority is valid. Criminal or civil law liability presupposes firm intention or gross negligence. The first helper can assert damages of his own to the victim and the accident insurance company.
