La validation du principe de non-régression en matière environnementale par le Conseil constitutionnel au prix d’une redéfinition a minima de sa portée

Abstract

The non-regression principle in environmental law : a validation, by the French Constitutionnal Council, in a limited scope. This article analyses the consequences of the Decision n° 2016-737DC of the French Constitutional Council wich declared the principle of non-regression compatible with the constitution. Nevertheless, the Council confirmed his previous jurisprudence excluding the possibility for the parliement to adopt a law limiting his competence. Thus, the principle will have a limited scope, and will narrow the competence of the executive, but not the legislative power.
