Abstract

The author hypothesizes whether environmental protection norms, to date, constitute an imperative norm of international law (Ius Cogens). To test his hypothesis, he counteracts the current state of law, with the latest advances in the studies on Ius Cogens of the International Law Commission (ILC) of the United Nations.The primary objective of the article is to contribute, from the academy, to the efforts that the ILC is making in the study of Ius Cogens. The author considers necessary that Uruguay be formally present in the discussion on the subject of Ius Cogens in general and particularly in the contribution to the current state of International Environmental Law.This work is the culmination of the research carried out for the approval of the XLVI Course on International Law of the Organization of American States, held in Rio de Janeiro, Brazil in July - August 2019.
