Abstract

The increase in hate speech and hate crimes based on sexual orientation and gender identity in Europe has led the Council of Europe to become increasingly concerned with the issue. In this paper, we study the case law of the European Court of Human Rights on the subject to ascertain the level of protection afforded to individuals against homophobic and transphobic hate speech and hate crimes.
