Abstract

This study presents some reflections on the figure of the magistrate in marriage cases, as an individual, as a bearer of justice, and in most cases as a priest. The labor of the magistrate is carried out amidst difficulties which have an effect on married life in the modern Western world and in the approach to some marriage cases. The magistrate must have a solid formation and be conscious of the special value of marriage, which is also considered a fundamental right of the faithful. The magistrate must particularly take into account the principle of favor matrimonii as an inspiration for the whole matrimonial canon law. He must undertake this labor as a ministry for truth and charity, keeping in mind the good of souls. There are important principles for the directive action of the magistrate in marriage cases. The criteria of the Pontificial Teachings of Pope John Paul II are particularly rich and informative on this subject
