Abstract

Sexual orientation in adoption rights. Although not dictated by sexual orientation, French statutes do in effect limit adoption access for same sex couples or homosexual individuals. Practical considerations accentuate the phenomenon such as the low number of children available for adoption in France, the reticence in other countries in light of requests from homosexuals, the authorities’ preference for heterosexual applicants. However, positive developments can be considered over the more-or-less long term thanks to the case law influence of the European Court of Human Rights which considers any difference in treatment between homosexuals and heterosexuals in terms of adoption as discriminatory.
