Abstract

In French law, the contradictory nature of each procedure is an essential element that must always be scrupulously monitored, or there is a risk of invalidation. This notion is important, especially in the course of a medical assessment because, by confronting different points of view, it allows one to approach truth. A real contradiction would evidently necessitate a discussion on “equal footing” between the protagonists, and a discussion between equally competent partners. A correct application of this fundamental principle produces a sense of reciprocal loyalty and equity, which is indispensible for all parties to be satisfied with the conclusions of the medico-legal assessments.
