Abstract

The provisional measures order issued on May 25, 2019 is part of a dispute between Ukraine and the Russian Federation over the detention of three Ukrainian military vessels and the imprisonment of its crew, which takes root in the parties’ opposition regarding their sovereignty over the Sea of Azov, the Kerch Strait and the Black Sea, that is, the maritime zone boarding Crimea. In the case at hand, the ITLOS order gives full satisfaction to the applicant, on the basis of an extended conception of its prima facie jurisdiction.
