Abstract
The expert evidence is very useful and important both in civil and criminal procedure. It helps to knowledge of the truth, but it also creates real difficulties for both the admission and assessment of the evidence provided by the experts who, drawing upon the expertise and complex, new research methods, provide opinions. Judges should have the ability to analyze indicated opinion, especially, they should have the “tools” to assess their value. It is still the challenge to evaluate the expert opinions that are based on new research techniques. Hence there is a need to create a model of American law transparent criteria for evaluating the expert's opinion and unification of standards to facilitate the use of it in the process of adjudication and calls for a further specified and consistent criteria that would have to meet the new, not previously used test method. This will enable the protection of justice against not scientific evidence and force to develop an appropriate system of selection of experts, guaranteeing reliability and high level of testing carried out and drawn up on the basis of the opinion.
