Abstract

Most of the areas in West Sumatra are still recognized as land within the customary law community, whose management, control and use are based on local customary law provisions and are recognized by the community concerned as communal land. One of them is the communal land of the people. In its development, ulayat land can be registered in the form of land ownership certificates. This study uses empirical jurisdiction and is specialized in the conversion of communal land into ownership rights through the PTSL program. Obtaining a land right and obtaining a certificate of land as proof of ownership can be accomplished in two ways, namely the conversion of the former old right and the former customary land right as well as the application for rights. The aim is to maintain the integrity of the rights of these indigenous peoples, especially the people in Minangkabau, so the registration of ulayat land is carried out to obtain a certificate as a strong and acknowledged evidence of the State. This is also in line with the purpose of the LoGA which recognizes customary rights and is accompanied by Regional Regulation of the Province of West Sumatra Number 6 of 2008 concerning Ulayat Land and Utilization. One of the active land registration programs conducted by the government is the Complete Systematic Land Registration (PTSL).
