Abstract

The article discusses the issue of the legal basis for the EU to take action in the field of digitization of public administration in EU Member States. The lack of a provision authorizing the EU to take action in this area means that the current EU legal framework consists of point solutions and is based on different legal bases depending on the scope of the adopted act of secondary legislation. However, EU institutions and Member States notice the need for a comprehensive regulation solving problems affecting the development of e-government in Europe. A holistic approach to the digitization of government is needed especially in the case of cross-border issues common to any e-government implementation environment, in particular citizens’ rights. An example of EU action in this regard is the European Declaration on Digital Rights and Principles in the Digital Decade.
