Abstract
This research was conducted to determine status and legal consequences of village head on the village management in accordance with the provisions of the village legislation. This research approach used normative juridical approach in the sense of examining norms and rules relating to issues to be discussed. Supporting data were secondary data that is obtained from library, legislation in force, and theories that exist in the literature relating to the village. The data collection is obtained by organizing a literature study (Library Research). This research result showed that the presence village head aimed to implement village government in accordance with the provisions of the legislation in force and obtained legal certainty to the community.

Summary
ABSTRAK Studi ini dilakukan untuk mengetahui kedudukan dan akibat hukum pejabat kepala desa dalam penyelenggaraan pemerintahan desa sesuai dengan ketentuan peraturan perundang-undangan tentang desa. Pendekatan yang dipakai dalam kajian masalah ini dilakukan dengan cara pendekatan yuridis normatif yaitu pendekatan dalam arti menelaah kaedah-kaedah atau norma-norma dan aturanaturan yang berhubungan dengan masalah yang akan dibahas. Data yang digunakan dalam menunjang studi ini adalah data sekunder yang didapat dari bahan-bahan kepustakaan, peraturan perundang-undangan yang berlaku, dan teoriteori yang ada dalam literatur-literatur yang berkaitan dengan Desa. Pengumpulan data dilakukan dengan cara mengadakan studi kepustakaan (Library Research). Dengan studi ini memperlihatkan bahwa adanya pejabat kepala desa bertujuan untuk terselenggaranya pemerintahan desa sesuai dengan ketentuan peraturan perundang-undangan yang berlaku dan mendapatkan kepastian hukum terhadap masyarakat dalam penyelenggaraan pemerintahan desa.
