Abstract
An analysis of Justice Windeyer's well-known obiter dictum in 'Victoria v Commonwealth' concerning the 'Engineers' Case' is presented. It is argued that Windeyer J's views regarding the basic structure of the Constitution lacked coherence. Three theoretical possibilities that could explain the apparent inconsistencies in his dictum are considered.
