Abstract

Barry C. Feld finds that, despite the ruling, many juveniles remain unrepresented in legal proceedings. Noting the transformation in recent years of the juvenile court system from an informal, rehabilitative agency to a scaled-down criminal court, Feld questions whether there is any reason to maintain a separate court system. He examines three possible alternatives to the current system, which, he alleges, punishes in the name of treatment while denying to juveniles the elementary procedural safeguards insisted upon for adults.
