Abstract

This article discuss the effectiveness of fundamental rights in private relations and the function of the Constitutional Jurisdiction. The study covers the fundamental rights, Constitutional Jurisdiction and individual liberty in private relations. The theories of horizontal effectiveness and judgments by the Brazilian Supreme Court are presented. The conclusion is that, in Brazil, predominates the thesis of the direct effectiveness of fundamental rights to private relations, especially those where there is a power relation.
