Abstract

In this paper an attempt is made to evaluate the law relating to jurisdictional immunity in India of a foreign state enterprise. Such an endeavor carries a special significance in contemporary international trade, wherein a State, itself or by its commercial enterprises, is increasingly participating in trade and its entitlement to certain privileges such as disclosure of document, proof of foreign law, affirmative defenses of force majeure, Act of State and jurisdictional immunity becomes significant.
