Abstract

The article deals with problematic issues challenging sub-legal normative executive power bodies ofUkraine. Subordinate normative executive power bodies are often issued with violation norms contained in law, sometimes even contrary to legislative provisions, their number is constantly growing at a rapid pace, while not differing in proper quality. At same time, quality legal regulation public relations in state, protection interests, rights and freedoms citizens depends entirely on quality subordinate normative and legal acts, since no matter how perfect law was not regulated in one or another sphere public life, without proper implementation legislative provisions executive authorities, legal regulation can not be effective.To date,Ukrainehas two ways resolving administrative and legal disputes - administrative and judicial. Administrative is possibility addressing a person whose rights, freedoms and legitimate interests are violated, with a complaint to the body which directly violated its rights, or to a higher authority, and court - in possibility of appeal a natural or legal person with a complaint directly to court » Taking into account above, it can be noted that procedure for appealing sub-legal normative can be divided into: 1) administrative, which may include: abolition rule-making body, abolition a parent body; abolition by body justice decision on state registration regulatory legal act and 2) court, which may be subject to appeal regulatory legal in court.It is believed that court order appeal has certain advantages over administrative ones. One main guarantees protection rights and freedoms individuals and legal entities inUkraineis right to apply to court if these persons consider that their rights, freedoms and legitimate interests are violated. Introduction

У статті досліджено проблемні питання оскарження підзаконних нормативноправових актів органів виконавчої влади України. Встановлено, що порядок оскарження нормативно-правових актів органів виконавчої влади можна поділити на адміністративний і судовий. Результатом реалізації органами виконавчої влади нормотворчих повноважень є видання відповідних підзаконних нормативно-правових актів.
