Abstract

In this chapter, the author writes about judges ad hoc in International Tribunal for the Law of the Sea (ITLOS). The provisions on judges ad hoc in the Tribunal's Statute can be traced back to the corresponding provisions in the Statutes of the Permanent Court of International Justice (PCIJ) and the International Court of Justice (ICJ). Judges ad hoc have the same rights and duties as the elected members of the bench; according to the Statute, they shall participate in the decision on terms of complete equality with their colleagues. Finally, a few words on the requirements for nomination: a judge ad hoc chosen by a party to a dispute may not be confirmed if he has previously taken part as agent, counsel or advocate for one of the parties, or as a member of a national or international court or tribunal, or in any other capacity.
