Abstract

This chapter will provide an overview of the investigatory and adjudicatory process at the International Criminal Court, including the gathering of evidence, witness protection, and the mechanics of the trial process. The chapter will also summarize the nine situations currently under investigation. The challenges of controlling the investigation of an uncooperative government, as well as the special obstacles faced by defense counsel are included. The role that victims play in criminal proceedings is an additional emphasis of this chapter. As an effort to promote the restorative goals of the transitional and post-conflict justice movement, victims have legal representation and a formal role in the trial proceeding.
