Abstract

The introduction aims to place the debate on the constitutionalization of private law in the overall context of the increased role of fundamental rights and human rights not only in private law but in the overall interpretation of legal rules at the member states level. The seven contributions are then linked to the broader framework of constitutionalization of European private law via human and fundamental rights. In a third step, common denominators and under-discussed issues deserving closer inspection are identified.
