Abstract

This study aims to present the points of contact between the traditional legal regime of trademarks established in Brazilian Law nº 9.279, 1996, and the legal implications that involve domain names on the Internet. The main conflicts between domain name holders will also be analysed, always seeking points of connection with the brands. After showing the relations between trademarks and domain names on the Internet and also the main violations against domain name system, it will be made an analysis of the Brazilian Federal Court jurisprudence, in which it will emphasize the elements of tension between the two institutes. In the end, it will be verified whether, as a part of the doctrine defends, the trademarks and domain names on the Internet must be treated differently or, on thecontrary, both institutes reveal a kind of similarities, although they can be distinguished.
