Abstract

For a long time, the sport's governing system was conceived as a self-contained regime where public law and State authorities did not have a clear role to play. But in the last few years, sports governing bodies have been challenged by strong demands from public authorities to increase their level of legal scrutiny, democracy, transparency and respect for fundamental rights. This work defends the application of the fundamental principles of public law to sports activity and maintains that the role to be played by public international law is one of the key elements in that regard. In particular, the fight against doping in sports will be considered as a case study.
