Abstract
Having briefly discussed the general principles of the law of contract in the previous Chapter, we now turn to the domestic laws of international sale. This and the subsequent chapter thus seek to provide a brief account of the key aspects of Indian and English law governing a contract of sale. The emphasis is placed on those aspects of the law that have international dimension. The aspects covered in this chapter include: a brief introduction of the relevant statutes on the subject; the nature and the subject-matter of a contract of sale; a distinction between a contract of sale, on the one hand, and other transactions relating to goods, such as exchange of goods, bailment, pledge, and hire purchase agreement; as well as transactions concerning services and work contract, on the other; a distinction between goods and services. The underlying purpose is to highlight the similarities and differences between the laws of the two countries.
