Abstract

AbstractThe authors studied the results of whiplash related law suits in the Swedish legal system, comparing the plaintiff's and the insurance defense. Two analyses were performed, one on cases during 1999–2000 at the district court in Stockholm, and one on appeal verdicts to the court of appeal (Svea hovratt) during January 2000 to June 2002. The results demonstrated that a plaintiff in the Swedish system is at a disadvantage with regard to attorney experience, qualifications of experts, and accountability of experts. Plaintiffs prevailed in 36% of the cases, while defense won 64% of the time.
