Abstract

In any event, Professor Tullio Scovazzi's analysis shows that the Law of the Sea (LOS) Convention is indeed applicable to new issues. Referring to genetic resources, Professor Scovazzi points out that the LOS Convention cannot provide any specific regime for the exploitation of the genetic resources of the Area. Professor Scovazzi recognises that not all of the Convention should be set aside. He points out that the regime of the Area encompasses other matters besides mining, including marine scientific research (MSR), the preservation of the environment and the protection of underwater cultural heritage. Professor Scovazzi's point is that the activity of bioprospecting could be considered as falling under the regime for MSR. The institutional aspects of a future regime, refers to the need to bear in mind the mandate and responsibilities of the International Seabed Authority (ISA).
