Abstract

Authored by one of India’s key negotiators of the Broad-based Trade and Investment Agreement (BTIA), this chapter provides a succinct analysis of the salient aspects of the negotiations that started in June 2007 and went on till April 2013, when they came to a standstill. The author discusses the mismatch of respective ambitions, the different procedural mechanisms of the two sides and how the two sides dealt with the difficult issues like agriculture, automobiles, wines and spirits, services, intellectual property rights, sustainable development and human rights. He goes on to examine the reasons behind India’s termination of Bilateral Investment Treaties, the issue of confidentiality in negotiations, the role of civil society and the impact of Brexit on the BTIA. The author concludes that if and when a BTIA is concluded, it would essentially be a sui generis one.
