Abstract

This article discusses the architecture of a state of exception in Brazil, in which the force of law was used as a political weapon (Lawfare). It points out that the 4th Federal Court, in Curitiba, acted as a court of exception from a series of practices that hurt the national constitution and due process of law, and which interfered with the normality of the political process. As examples, he analyzes the process of monthly, the impeachment of President Dilma and Lava Jato’s actions, which culminated in Lula’s arrest and paved the way to Bolsonaro’s election. It is concluded that part of the Brazilian judiciary acted as a political agent using the law as a weapon.
