Abstract

Administrative and legal provision of relations in the field of municipal and housing economy has been studied in the article. The purpose of the article is to study the areas for improving administrative and legal regulation of relations in the field of municipal and housing economy in terms of the formation of the market of municipal and housing services in Ukraine. The author of the article has used the method of analysis, formal and logical, comparative and legal method. The analysis of the provisions of the current legislation regulating these relations contributed to the definition of the problems of this publication, as well as to the formulation of the author’s vision for improving administrative and legal provision of relations in the field of municipal and housing economy in Ukraine. The author has analyzed the problems of legal regulation of relations in the field of municipal and housing economy and factors that negatively affect its development, in particular: the level of tariffs that does not correspond to the volume of expenditures of the enterprises of municipal and housing economy, the need to provide municipal and housing economy with qualified human resources, insufficiency of own material resources of local self-government agencies, gaps and conflicts in the current legislation, inefficient management of the area and lack of competition in the market of municipal and housing services, depreciation of main assets, etc. Specific features of the legal provision of the reform of municipal and housing services’ market have been clarified. The object of state administration of municipal and housing economy has been determined. The directions of improving legal regulation of relations in the sphere of municipal and housing economy have been considered, namely: creation of the effective market of municipal and housing services, reforming of management system in the field of municipal and housing economy, improvement of regulatory provision. It has been concluded that the result of state regulation in the field of municipal and housing economy should be the restriction of natural monopoly, control over the quality of municipal and housing services, social guarantees for consumers of services, etc. At the same time, it has been noted that the restriction of state influence on the formation of tariffs for municipal and housing services allowed local self-government agencies to take into account the specifics of the area, where they are provided, as well as the needs of consumers of these services.
