Abstract

Recommendations have another prominent place in the hierarchy of EU policy instruments and have been issued on various issues, including the transposition of EU legislation across Member States. At consecutive EU summits, the European Council has repeatedly urged Member States to accord high priority to the national implementation into national law of directives affecting the Single Market. Recognizing the importance of a properly functioning Single Market for the competitiveness of the European economy, the Commission has expressed concern about the poor Member States’ implementation records. Given the importance of full compliance and the repetitive nature of Member States’ failure to do so, in 2004, the Commission (2004e: 9) more specifically urged for the first time ‘Member Sates to re-examine their administrative procedures and practices to ensure that they consistently meet this legal obligation’.
