Abstract

In the framework of this article an attempt has been made to identify the impact of the judgments of the European Court of Human Rights on law-making activities in the Republic of Armenia. The main aim of this article is to reveal the unique role assigned to the parliaments in the process of implementation of European standards for the protection of human rights. The topic at issue has been studied under the light of the relevant resolution of the CoE Parliamentary Assembly and the recommendation of the CoE Committee of Ministers. In the first part of the article, some issues have been viewed related to the parliamentary oversight in the Republic of Armenia while ensuring the harmonization and verification of compliance of draft laws with the conventional standards for human rights protection, in the second part, some issues concerning parliamentary monitoring have been referred to. The objective of this article is to reveal the types of impact of the judgments of the European Court of Human Rights in the context of parliamentary oversight and parliamentary monitoring in the Republic of Armenia and suggest ways to improve existing legal mechanisms in that regard. In the framework of this article, both general scientific and jurisprudence-specific methods have been used, such as legal comparative and formal-legal methods and the method of systematic analysis. Based on the results of the study, it has been noted that the parliamentary oversight in the Republic of Armenia in terms of ensuring the harmonization and verification of compliance of draft laws with the conventional standards for human rights protection as a mandatory function lacks for effective mechanisms. Thus it has been suggested to clarify the issue raised in the process of reviewing the spheres of activity of the standing committees of the RA National Assembly.
