Abstract

We offer a graphical display of the swing votes between all actual and possible tight majorities of the United States Supreme Court from 1946 to 2016. We observe and ebb and flow of the number of 5–4 coalitions and swing votes. We also note various inconsistencies with the median voter theorem and incompatibilities with locational models of adjudication.
