Abstract
The article describes the history of the evolution of fixed matches in Ukraine. A lot of matches with a fixed result of different levels were carried out in Ukraine since independence, but only disciplinary responsibility came from FIFA and UEFA.The purpose of this article is studying domestic and foreign legal, conducting criminal law analysis of Article 369-3 of the Criminal Code of Ukraine (illegal influence on the results of official sports competitions) and providing suggestions for its improvement.After analyzing сorpus delicti foreseen for Art. 393-3 of the Criminal Code of Ukraine, which was enshrined in 2015, but this did notsolve the real problem of fixing mathesin Ukraine due to the imperfection of the legislative formula of this composition, which complicates the qualification of the crime and the further prosecution of football corrupt officials. As a result of learning international experience in the fighting against fixed matches in football, it was concluded that a big amount of countries sees this crime as a form of fraud.In the article are proposed, two ways of solving problem posed firstly by improving the content of Art. 369-3 of the Criminal Code of Ukraine, and changes to the wording of the notes to this article by replacing the «subject of the offense in this article» with «the subject of the criminal offense in this article»; secondly, taking into account the experience of foreign states to exclude article 369-3 of the Criminal Code of Ukraine from the Criminal Code of Ukraine and attribute fixed matches with a fixed result of fraud, namely, to fix a special composition – sports fraud, considering this crime as corruption, and to add a note to art. 45 of the Criminal Code of Ukraine, which provides types of corruption crimes.
