Abstract

There are approximately 9 million illegal aliens in the United States.1 A recent U.S. Supreme Court ruling, Hoffman v. NLRB (2002) and subsequent case law have brought into focus the issue of whether these individuals are entitled to lost wages or earning capacity under common law tort actions and how such damages should be calculated. This paper addresses these issues. Part I reviews developing case law on the subject. Part II discusses some technical issues faced by the economist when estimating foreign wage based earning capacities and then converting to damages expressed in dollars. Part III provides a summary.
