Abstract

In this paper, I explore the pertinent question of human rights in the East African Community. There have been debates as to whether the East African Court of Justice has a human rights jurisdiction and if so what international instruments should it apply?. There have been suggestions within the corridors of power to have the community develop its own human rights Protocol to cater for human rights. This debate has not yet been concluded partly due to the fact that the court has not been clothed with an express human rights jurisdiction though the court has entertained human rights matters. I make a small contribution to this very pertinent discussion. I hope you find this useful.
