Abstract

This statement addresses the topic of case selection and review at the Supreme Court. It considers the decline in cases on the Court's regular and how that is related to views of precedent. It also considers the increase in high-profile cases on the Court's docket, and analogizes the shadow docket to the preliminary injunction.
