Abstract

The European Small Claims Procedure was designed by the European legislator to provide consumers with an effective legal instrument to facilitate access to justice and to ensure the exercise of their rights in the cross-border situations. However, despite the benefits this process brings in terms of reducing the costs and time limits in cross-border claims, it is not still well known and remains underutilized several years after the entry into force of Regulation (EC) no. 861/2007. This article analyzes the changes that the Commission intends to make to this Regulation to promote efficiency of justice in the European Union and highlights and shadows.
