Abstract

According to article 1 paragraph 3 GG, state power is bound to fundamental rights. It is undisputed that this applies to the actions of German state authority within the borders of the Federal Republic of Germany without any foreign involvement. In the case of cross-border situations, i.e. situations that have a foreign element, the question arises as to how far the protection of fundamental rights extends and what effects a foreign legal system has on it. This thesis is dedicated to the clarification of the scope of application of fundamental rights for these constellations. In this context, a fundamental rights conflict of laws is outlined, which is intended to resolve any collisions between German and foreign fundamental or human rights.
