Abstract

Insurance companies are waging a massive, well‐financed war against their policyholders with the goal of nullifying billions of dollars of insurance policies. In that war, more than half of the 50 states, as well as a number of federal, state, and local government agencies, have supported policyholders. Insurance companies are asking the courts to nullify insurance policies because insurance coverage for pollution or environmental losses, they say, “violates public policy. “ Except for one lone voice, all of the federal and state government agencies—the keepers of public policy—that have thus far spoken have disagreed with the insurance companies.
