Abstract
Purpose – This study aims to demonstrate that companies are not free to operate in the e-commerce field, notably with regard to geoblocking and geopricing practices, since they must duly respect constitutional economic order principles.
 Methodology/approach/design – The methodology of the paper is based on Mike Feintuck’s public interest theory, according to which there are values beyond those of market economics that should be preserved, often to the detriment of private interests. Furthermore, the Decolar.com case is used as an empirical case study.
 Findings – It has been identified that geoblocking and geopricing practices can effectively violate constitutional principles and that consumer and antitrust microsystems can suppress those conducts, shaping the performance of economic agents to the public interest.
 Practical implications – The results of this article indicate that consumer and competition agencies can act more actively to curb the harmful geoblocking and geopricing practices.

A internet, o big data, os algoritmos computacionais, a inteligência artificial e o aprendizado automático de máquina (machine learning) trazem inúmeros benefícios para as pessoas, por meio, por exemplo, da redução de preços, do incremento da qualidade e da variedade de produtos e serviços e do aumento da inovação. Tendo em vista a potencialização e a maior disseminação de tais práticas de geodiscriminação graças à expansão do big data e dos algoritmos, tem ficado cada vez mais claro que tais condutas podem gerar (e de fato têm gerado) um série de efeitos nefastos à economia e aos consumidores. Ambos estes microssistemas partem do pressuposto de que outros valores que aqueles da economia de mercado (orientados a interesses privados) precisam ser alcançados, de sorte a pautar a intervenção estatal sobre a economia como um meio de alcançar o interesse público, revelado por uma série de princípios e valores constitucionais. A seguir, será examinado de que forma as práticas de geoblocking e geopricing são (ou podem ser) enfrentadas pelos microssistemas da defesa do consumidor e da concorrência
