General legal safeguards for the International Criminal Tribunal for the accused

Abstract

The criminal justice considered as the ultimate goal which is seeking to achieve it, that fore it is represented the standard which granted the human rights respect and his freedom and reflected the level of the civilized approach for the society. To achieve that required the availability of justice, efficiency responsible and natural judicial system, able to embody the legal stipulation on the real situations. So the law sovereignty and the worthiness of the independent justice judicial organization are characteristics of essential components in order to separate the justice. The judicial grantees' that granted to the accused for the international criminal court the main path to reach justice, specially the procedures that are taken place in the international criminal court contained the most dangerous procedures, because its connected with the human right and his freedom as considered restrictions imposed upon the man intent to reach the truth, because it is the target of the international judicial justice. Upon that base it is required by the court to build an equitable formula in order to achieve the conveniently between two benefits, the benefit of the international society by revealing the truth that guided to the real offender in order to take his suitable penalty. On the other, hand, to activate the legal stipulations that safe the guarantees granted to the accused in all suitcase stages, and to put itself faraway of giving priority of one party benefit on account of an other, whereas the consecration of enough guarantees for the accused are measured by the extent of respecting and implementing the stable principles in the national criminal legislation which confirmed by the international criminal legislation. About this research, the legal general guarantees for the international accused in front of the international criminal court is explained in two chapters. The first chapter explained the concepts of the international criminal court, and the international accused and divided its subject into three requirements, the first requirement identification of the international criminal court, the second the specializations of the international criminal court, and the third the concept of the international accused. The second chapter, the researcher explained the general legal guarantees for the international accused, and divided it in to three requirements. The first the respect of the justice independent principle, the second the respect of criminal legitimacy principle and the third the respect of accuse innocence principle.
