Abstract

It has become very difficult to give a concise overview of Dutch climate policy. The Dutch government does not have a preference for a Climate Protection Act (such as the Climate Change Act adopted in 2008 in the United Kingdom), which would provide an overview of the main regulatory measures for mitigation and adaptation. In the Netherlands, the political parties do not even agree over the existence of the human-induced global warming threat—the rather new and fast developing right wing party, which is called the Party for Freedom (PartijVoor de Vrijheid) and is currently supporting the minority government, contests the need to take climate protection actions. Remarkably, there is also no case law yet within the Netherlands dealing with the need for climate change measures. One can imagine that possible victims would ask for some mitigation or adaptation measures, while those who need to face obligations...
