Abstract

The Principles of Civil Procedure of the USSR and the Union Republics provide that every party concerned has the right, under procedure established by law, to go to court for protection of a violated or challenged right or of an interest protected by law (Art. 5). Because of the particular importance of this right, the same article of the Principles provides that refusal to grant the right of recourse to a court is invalid.
