Abstract

This paper examines the historic development of a doctrine of Legislative Consultation that is due to First Nations by the Canadian Government. Currently, the Canadian Government does not recognize a duty of consultation with First Nations prior to the passage of amendments to the Indian Act or the creation of new legislation that directly affects First Nations people.This paper argues that Canada must consult with First Nations on legislation as it does on actions that will affect Aboriginal and Treaty rights.
